MICHAELA KOBLASOVÁ STRENGTHENS THE WEINHOLD LEGAL TEAM

Prague (16 January 2012) - Weinhold Legal strengthened its expertise in arbitration and litigation with the arrival of senior attorney-at-law Michaela Koblasová.
Michaela came to Weinhold Legal from the Prague office of Baker & McKenzie. Before, she had worked with Mareš Partners and at the Secretariat of the ICC International Court of Arbitration.
Milan Polák, the head of Weinhold Legal’s litigation and arbitration team, commented Michaela’s arrival: “Our litigation and arbitration practice is very busy nowadays, and we have recently won numerous new assignments in this area. Thus, I am glad to see a strong practitioner joining our team.”
Michaela graduated from the Law Faculty of Charles University in Prague (JUDr. degree). In 2003, she received her D.E.A. degree in International Private Law and International Commercial Law at Université Paris I Panthéon-Sorbonne.
Apart from her native Czech, Michaela speaks English, French and German. Michaela is a member of the Czech Bar Association.
WEINHOLD LEGAL ASSISTED CZECH STATE IN WINNING ARBITRATION WITH GERMAN ENTREPRENEUR, R. J. BINDER

The law firm of Weinhold Legal successfully represented the Czech Republic in international arbitration proceedings initiated by German entrepreneur, Rupert Joseph Binder, in respect of the alleged frustration of his investment in the company CARGO TRANSPORT - INTERNATIONALE SPEDITION, spol. s r.o. The claimant asserted that his rights were breached by the actions of the Czech customs administration when enforcing guarantee claims against his company.
The proceedings before the international arbitral tribunal residing in Prague had been pending since 2005; the final award was rendered on 15 July 2011.
The arbitration proceedings were conducted on the basis of the Treaty concluded between the Federal Republic of Germany and the Czech and Slovak Federative Republic on 2 October 1990 regarding the Promotion and Mutual Protection of Investments.
The international arbitral tribunal dismissed all claims of the claimant lodged against the Czech Republic; the asserted claims totalled nearly 4 billion CZK.
“It is very satisfying that the tribunal, which was composed of reputable foreign arbitrators, unequivocally refused the assertions that the Czech-German Bilateral Investment Treaty had been breached,” said Daniel Weinhold.
Pilotní koncesní projekt ve vodárenství na Táborsku byl úspěšně dokončen

Advokátní kancelář Weinhold Legal, v.o.s. poskytla komplexní právní služby společnosti Vodárenská společnost Táborsko, s.r.o. (VST), vlastníkovi vodohospodářského majetku měst Sezimovo Ústí, Planá nad Lužnicí a Tábor, která dne 30. června 2011 uzavřela provozní smlouvu se společností ČEVAK a.s., společností ze skupiny Energie AG a došlo tak k úspěšnému završení koncesního řízení.
Toto koncesní řízení bylo svou povahou „pilotním“ koncesním řízením, a to nejen z toho důvodu, že se soutěžila „nová“ provozní smlouva odpovídající požadavkům OPŽP, ale také tím, že celý proces úzce monitorovala vedle národních orgánů MŽP ČR a SFŽP ČR také DG REGIO jako orgán Evropské komise.
Koncesní řízení na výběr provozovatele bylo zahájeno dne 10. října 2008. Dne 1. prosince 2009 zadavatel rozhodl o výběru dodavatele pro uzavření koncesní smlouvy (koncesionáře), kterým se stala společnost Vodovody a kanalizace Jižní Čechy, a.s., jejímž právním nástupcem se ke dni 1. května 2010 stala společnost ČEVAK a.s. Prodloužení doby trvání koncesního řízení bylo způsobeno tím, že celé koncesní řízení bylo v období od prosince 2009 do května 2011 přezkoumáváno Úřadem pro ochranu hospodářské soutěže, který vypořádal celkem 5 žádostí na přezkum úkonů zadavatele a ve všech případech byly žádosti uchazečů zamítnuty, tj. Úřad pro ochranu hospodářské soutěže posoudil postup zadavatele (VST) jako správný ve všech případech.
Díky koncesnímu řízení zadavatel dosáhl významného zlepšení ekonomických parametrů, za nichž je vodárenská infrastruktura provozována. Jak uvádí ředitel společnosti Vodárenská společnost Táborsko, Ing. Milan Míka, uzavření nové provozní smlouvy je zásadní podmínkou pro splnění podmínek rozhodnutí o dotaci z Fondu soudržnosti 2004 – 2006 - maximální částka podpory dle Rozhodnutí EK je 7 692 000 EUR, což podle předpokladů bude představovat zhruba částku 185 mil. Kč. Současně je také uzavření provozní smlouvy důležité pro dosažení shody s podmínkami OPŽP 2007 – 2013 pro získání dotace na rekonstrukci AČOV Tábor ve výši 97 mil. Kč. V neposlední řadě je uzavření nové provozní smlouvy také jednou ze zásadních podmínek úvěrové smlouvy na investiční úvěr ve výši 970 mil., dodává Ing. Míka.
